Employment Legislation Bill

1. Title

This Act may be cited as the Employment Legislation Act 2020.

2. Commencement

This Act comes into force after receiving the Royal Assent

3. Purpose

The purpose of this Act is to enhance the coverage of collective agreements and protect workers against the theft of tips.

Part 1 - Amendments to the Employment Relations (Liberalisation) Amendment Act 2019

4. Principal Act amended

This Part amends the Employment Relations (Liberalisation) Amendment Act 2019 (the principal Act).

5. Section 5 repealed

Section 5 is repealed.

6. Section 6 repealed

Section 6 is repealed.

7. Section 7 repealed

Section 7 is repealed.

8. Section 8 repealed

Section 8 is repealed.

Part 2 - Amendments to the Wages Protection Act 1983

9. Principal Act amended

This Part amends the Wages Protection Act 1983 (the principal Act).

10. Section 2 amended (Interpretation)

Replace the definition of “wages” with the following definition in its appropriate alphabetical order:

wages means salary or wages; and includes time and piece wages, and overtime, bonus, or other special payments agreed to be paid to a worker for the performance of service or work; includes tips when agreed to be paid to a worker or where no such agreement exists; and also includes any part of any wages

11. Section 14 amended (Wage theft)

(1) Replace “.” with “:” in subsection (1)(d).

(2) Insert the following after (1)(e):

• (f) not allocating all tips earned by a worker in the absence of any agreement on tips:

• (g) not allocating all tips to be allocated under any agreement governing the allocation of tips.
