On Halloween 1981 tom riddle #1 enters the Potter home, murders James Potter, offers Lilly Potter the option to leave, murders her after her refusal, then uses one or both of those murders to initiate the traditional Horcrux procedure and is at this point discorporated.

Tom makes it clear that he used the goblet of fire to enact a magical contract between all Toms Riddle, that none of them can harm another unless that one has harmed them first.

My hypothesis is this, Horcruxing someone counts at harming them and the check of "is this person a Tom riddle" is done before that harm stops.
