I live in a developing community and recently installed a 5-foot fence, which is the maximum height allowed according to the HOA bylaws.

However, I've noticed that several neighbors have 6-foot fences. We just received a notice stating that the developer will be inspecting fence heights and boundaries. Anyone found in violation will be required to correct or remove their fence.

Some neighbors claim their 6-foot fences were approved by the HOA, while others said their requests were denied.

I find this situation unfair for those of us who followed the HOA rules. I would have preferred a 6-foot fence but chose not to, as I agreed to abide by the HOA guidelines.

Has anyone experienced a similar situation? Can the developer enforce the removal or modification of fences that were incorrectly approved by the HOA?
