Question about custom kingdom and de jure land

Can someone look into the create custom kingdom decision and explain to me what determines whether the provinces held will become de jure of said custom kingdom? Does it have something to do with their original de jure kingdom title not being created?
EDIT: Found out the answer myself - it was in the patch notes of Open Beta Patch 2.2.0.1
Now custom kingdoms instantly dejure drift on formation, however only if the dejure kingdom/empire is not created and if you completly control the titles.
