This needs a bit of backstory- In 2022 my family got Lola, a 9 week old purebred Chihuahua. We got her through the breeder in a âGuardianshipâ program. A guardianship program allows a family to take a dog and basically adopt them, except the breeder gets to take them back during heat to breed them, and you get them for most of their pregnancy until they are due. I told my mum that this was a bad idea and she wonât want to breed Lola after sheâs had her for a year, but my mum dismissed it- low and behold, 6 months later when Lola goes through her first heat, my mum is worried and doesnât want to tell the breeder because Lola is still so little. Lola did end up getting bred this year, in around October with a due date of December 10th, but she ended aborting them/ having a miscarriage 2 weeks prior on the 29th of November. This was extremely traumatic for the whole family but especially Lola who had on and off maternal instincts, but ended up taking her toys in like they were her puppies and getting extremely possessive of them, which isnât uncommon. The thing is, my parents had a verbal contract with the breeder stating they would pay her $5000 and she would have one (1) litter, but the breeder is now trying to make Lola have a second litter, even though sheâs already had one, it just wasnât a successful litter. Is there anything we can do about this? She is still registered to the breeder as per the guardianship program, my parents have paid the $5000, and we canât afford to go to court because of this.

Edit 1: Iâve read through the comments (the ones that havenât been removed) and have a couple of things to add: We didnât pay for her originally during the guardianship, and we had her for over a year before my parents decided they would pay the money to fully purchase her to not put her through the stress of lots of litters. There is no physical contract for the new agreement and the original agreement does not stipulate what a litter is. The original contract was written and signed, but the new one (for full purchase) was verbal. The breeder has a number with Dogs Victoria. (I have called RSPCA on multiple neighbours in the past) I agree very much that this should be illegal, but sadly it isnât. We also have Lolaâs mother and she is extremely timid and I have a hunch that she may have had a bad past with humans, especially men. The guardian contract did not outline what a litter is, but after reading it again, I have discovered she has broken it multiple times by not doing things that have been outlined to be done by the breeder, and also there is a clause read âIf the dog is female and there is a problem with any pregnancy that endangers the health of that dog, no future breeding will be required, the dog will be spayed as soon and medically appropriate, and ownership transferred to the guardian.â And the vet when I took her in to the vet, the vet recommended we spay her as soon as possible. Do you think we have a case?
